Customer review

Litigating against state-owned institutions is always a headache. In our case, the customer simply refused to sign the completion certificates and pay under the contract, even though we delivered everything on time. We turned to KDPartners for help.

Their legal team stepped in immediately: they gathered all our correspondence, reports, and factual evidence of work performance, and took the matter to court. Ultimately, the Moscow Arbitration Court sustained our claim in full — we recovered the principal debt, penalties, and even our legal expenses. We are completely satisfied with the outcome. Big thanks to the team for managing the case and taking the stress of litigation off our shoulders.

FAQ

Can a contractor recover legal fees from a government customer?

Yes, such expenses can be recovered from the state customer, provided there is proper documentary evidence of the legal services agreement and proof of payment.

Is a government customer required to pay a completion certificate if the contract term has already ended?

Yes. If the services were rendered before the contract expired, the customer is legally obligated to pay. The expiration of the agreement does not wipe out obligations that were fulfilled during its term.

How do you prove services were rendered under a contract if the government customer refuses to sign the completion certificate?

You must submit a copy of the certificate to the court along with a cover letter and proof that these documents were properly sent to the customer. Supporting evidence like cost estimates, correspondence, verification of work volume, and records of previously accepted identical certificates will be considered sufficient proof by the court.

What should a contractor do if a government customer refuses to return a 10% retention after project delivery?

First, send a formal written pre-trial demand and secure all evidence proving that the work was completed. If the customer still refuses to pay, you should file a lawsuit, justifying the illegality of the retention by citing the contract terms, Civil Code provisions, and relevant case law.

Can a guarantee retention be recovered under a government contract if the contract has already expired?

Yes. If the contract work was properly performed and the customer's obligation to return the retention was tied exclusively to its own future actions, a court can rule such a dependency unlawful. The expiration of a contract does not release a party from fulfilling obligations incurred while it was active.

Consequences and Contractor Defenses When Clients Fail to Deliver Initial Data for Construction Design in Russia

Construction design and engineering deliverables cannot be successfully executed without a comprehensive and accurate set of initial baseline data, including site boundaries, technical specifications, and survey results. When a client fails to transfer these mandatory materials, design operations are immediately blocked, exposing the contractor to project downtime, schedule overruns, and severe financial penalties or potential blacklisting in public procurement registers. Successfully navigating client default requires enforcing statutory work suspension rights, issuing formal notices, and establishing an unassailable evidentiary record for commercial arbitration courts.

Protecting Copyrights in Construction Design Documentation in Russia

Construction design documentation serves as the foundational legal and technical asset for real estate development and architectural execution, encompassing drawings, layouts, visualizations, and engineering specifications. Because of significant development costs and unique creative solutions, project documentation represents an independent intellectual property (IP) asset that requires rigorous legal protection. Unauthorized reproduction, derivative modifications, or uncompensated transfer of architectural concepts to third parties create severe commercial exposure for international investors, developers, and corporate entities operating in Russia. Establishing a robust IP strategy ensures comprehensive asset protection and transparent commercial contracting across all project phases.

Proving Client-Induced Delays in Construction Design Contracts in Russia

When a construction design project in Russia experiences severe schedule overruns, contractors frequently face aggressive liquidated damage claims and potential blacklisting unless they can legally attribute the delay to the client's operational defaults. Under Russian civil law and procurement statutes, clients are statutorily obligated to establish proper administrative and technical conditions for timely project execution, including delivering baseline data, reviewing deliverables within agreed timeframes, and refraining from unilateral scope modifications. Successfully shifting liability requires strict compliance with statutory work suspension protocols, formal event logging, and rigorous pre-trial documentation.
