Customer review

In the first instance, we faced a very unfavorable ruling: the court ordered us to hand over design documentation that we physically couldn't have had under this contract, and even awarded a fine with a daily penalty counter for non-compliance. We were exposed to significant financial risk due to a basic confusion between two separate state contracts.

KDpartners took on the case at the appeal stage. They clearly separated the obligations under both contracts and proved to the judges that all documents had long been delivered to the state under the first agreement, while nothing had been handed over to us under the second. The appellate court completely overturned the initial ruling and dismissed all claims. We are deeply grateful to the team for their thoroughness and professional work.

FAQ

Are state duties for filing an appellate complaint recoverable in state contract disputes?

Yes. Upon the reversal of the judgment and dismissal of the claim, the appellate court awards the state duty paid for filing the appeal to the defendant.

Is a court entitled to impose a duty to hand over documentation under a state contract if title to it never passed to the defendant?

No. The plaintiff bears the burden of proving that the defendant holds the documentation (or rights to it) specifically in connection with the contract in dispute. In the absence of such evidence, the claims must be dismissed.

What should be done if the design documentation was created and delivered under a different state contract?

You must collect and present delivery waybills, acceptance certificates, and contract performance records. This proves that the disputed documentation does not fall within the scope of obligations under the agreement in question.

Can a fine and daily penalty be recovered for failing to deliver documentation under a state contract?

Only upon proven non-performance of an existing legal duty. If the obligation to hand over documentation is not backed by the terms of the specific contract or the evidence in the case, claims for fines and penalties will be rejected.

How can one challenge a demand to hand over design documentation under a state contract for technical customer functions?

It is necessary to demonstrate the absence of the subject matter: the plaintiff must prove that the documentation was actually transferred or supposed to be transferred under the contract in dispute and is currently held by the defendant. Lacking such proof, the court will dismiss the claim.

Consequences and Contractor Defenses When Clients Fail to Deliver Initial Data for Construction Design in Russia

Construction design and engineering deliverables cannot be successfully executed without a comprehensive and accurate set of initial baseline data, including site boundaries, technical specifications, and survey results. When a client fails to transfer these mandatory materials, design operations are immediately blocked, exposing the contractor to project downtime, schedule overruns, and severe financial penalties or potential blacklisting in public procurement registers. Successfully navigating client default requires enforcing statutory work suspension rights, issuing formal notices, and establishing an unassailable evidentiary record for commercial arbitration courts.

Protecting Copyrights in Construction Design Documentation in Russia

Construction design documentation serves as the foundational legal and technical asset for real estate development and architectural execution, encompassing drawings, layouts, visualizations, and engineering specifications. Because of significant development costs and unique creative solutions, project documentation represents an independent intellectual property (IP) asset that requires rigorous legal protection. Unauthorized reproduction, derivative modifications, or uncompensated transfer of architectural concepts to third parties create severe commercial exposure for international investors, developers, and corporate entities operating in Russia. Establishing a robust IP strategy ensures comprehensive asset protection and transparent commercial contracting across all project phases.

Proving Client-Induced Delays in Construction Design Contracts in Russia

When a construction design project in Russia experiences severe schedule overruns, contractors frequently face aggressive liquidated damage claims and potential blacklisting unless they can legally attribute the delay to the client's operational defaults. Under Russian civil law and procurement statutes, clients are statutorily obligated to establish proper administrative and technical conditions for timely project execution, including delivering baseline data, reviewing deliverables within agreed timeframes, and refraining from unilateral scope modifications. Successfully shifting liability requires strict compliance with statutory work suspension protocols, formal event logging, and rigorous pre-trial documentation.
